CLARITY SOCIAL – TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the Clarity Social platform, including our website, applications, and related services (the "Service"). Clarity Social, Inc. ("Clarity Social," "we," "us," or "our") provides the Service subject to these Terms. By creating an account, accessing, or using the Service in any manner, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility and Accounts
1.1 Minimum Age. You must be at least 13 years old to use the Service, consistent with the Children's Online Privacy Protection Act ("COPPA").
1.2 Minors. If you are between 13 and 17 years old, you represent that you have permission from a parent or legal guardian, and that your parent or guardian agrees to be bound by these Terms on your behalf. Parents and guardians are responsible for monitoring and supervising the use of the Service by minors.
1.3 Account Information. You agree to provide accurate, current, and complete information when creating your account and to keep that information updated. You may not create an account using a false identity or on behalf of someone else without permission.
1.4 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or security breach.
1.5 Non-Transferable. You may not sell, transfer, or assign your account or any account rights.
2. Verified Real Life and AI-Generated Content Policy
2.1 Purpose. Clarity Social is designed to emphasize real, human-captured content and authentic experiences ("Verified Real Life").
2.2 Prohibited AI Visual Content. You may not upload, post, or share any AI-generated or AI-manipulated visual or audiovisual content, including but not limited to:
- AI-generated or AI-synthesized photos, videos, or audio,
- Deepfakes, face swaps, or other synthetic media,
- AI-enhanced visuals that materially fabricate or distort reality, including the people, places, or events depicted.
2.3 AI-Generated Text. Text-only content that is assisted or generated by AI is permitted, provided it complies with these Terms and is not deceptive, defamatory, or otherwise unlawful.
2.4 Detection Limitations. We may use manual review and/or automated tools to help identify AI-generated or manipulated content, but such tools are not perfect. You acknowledge that false positives and false negatives may occur, and Clarity Social is not liable for decisions based on such detection or non-detection.
2.5 Enforcement. Repeated attempts to upload prohibited AI-generated visual content may result in content removal, posting restrictions, suspension, or permanent termination of your account, at our sole discretion.
3. Authenticity, Editing Rules, and Staged Content
3.1 Minimal Editing Allowed. You may apply minor, non-material edits to real photos and videos, such as:
- Basic filters (brightness, contrast, color adjustments),
- Red-eye removal,
- Minor cropping that does not change the core context,
- Noise reduction and exposure correction,
- Basic audio cleanup, volume balancing, and noise reduction.
3.2 Prohibited Reality-Distorting Edits. You may not edit content in ways that materially misrepresent real-world events, including but not limited to:
- Adding or removing people, animals, or significant objects,
- Replacing or heavily altering backgrounds or locations,
- Warping, reshaping, or liquifying bodies or faces,
- Altering timestamps, locations, or contextual cues to mislead viewers,
- Any other manipulation intended to deceive viewers about what actually occurred.
3.3 Acting, Skits, and Staged Content. Skits, acting, role-play, and other staged or scripted content are permitted only if clearly disclosed using the platform's available tags, labels, or categories (for example, "Skit," "Acting," or "Staged"). You may not present staged content as real events or factual occurrences.
3.4 Deceptive or Manipulated Content. You may not post content that is intentionally misleading, deceptive, or designed to create a false impression of reality, whether through digital editing or staging.
3.5 User Responsibility. You are solely responsible for ensuring that your content is truthful, not misleading, and compliant with all authenticity and editing rules set forth in these Terms.
4. User Conduct, Prohibited Content, and Spam
4.1 Prohibited Content. You may not post, upload, or share any content that:
- Is illegal or promotes illegal activity,
- Harasses, bullies, or threatens any person or group,
- Incites or glorifies violence, self-harm, or suicide,
- Exploits or endangers minors, including sexual, suggestive, or otherwise abusive content involving minors,
- Is defamatory, libelous, or knowingly false,
- Infringes any copyright, trademark, or other intellectual property right under Title 17 of the United States Code or other applicable laws,
- Is deceptive, fraudulent, or misleading in violation of the Federal Trade Commission Act or state consumer protection laws,
- Misuses third-party names, logos, or marks, or falsely implies endorsement, in violation of the Lanham Act (15 U.S.C. § 1125) or similar laws.
4.2 Spam and Manipulative Behavior. You may not:
- Send unsolicited or bulk messages,
- Post repetitive or substantially similar content ("spam"),
- Use bots, scripts, or automation to interact with the Service,
- Artificially inflate or manipulate likes, views, follows, or other metrics,
- Operate scams, phishing schemes, or deceptive promotions.
4.3 Offline Interactions. You are solely responsible for your interactions with other users, whether online or offline. Clarity Social does not conduct background checks and does not guarantee the identity, intentions, or honesty of any user.
5. User Content, License, and AI/ML Use
5.1 Ownership. You retain ownership of any content you post, upload, or otherwise make available through the Service ("User Content"), subject to the license you grant to Clarity Social under these Terms.
5.2 License to Clarity Social. By posting or uploading User Content, you grant Clarity Social a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical and formatting purposes), distribute, display, and perform your User Content in connection with operating, maintaining, improving, and promoting the Service.
5.3 AI/ML and Algorithmic Use. This license includes the right for Clarity Social to use, analyze, process, adapt, and incorporate User Content and behavioral data (such as views, likes, follows, and other interactions) to develop, train, and improve algorithms, machine learning models, content recommendation systems, search and ranking systems, safety and moderation technologies, fraud and spam detection systems, and other features of the Service, whether they exist now or are developed in the future. Clarity Social may use aggregated, de-identified, or anonymized data derived from your use of the Service for analytics, research, and product development, even after your account is closed, to the extent permitted by applicable law.
5.4 Representations. You represent and warrant that you have all rights necessary to grant the licenses in this Section 5 and that your User Content does not violate any law or third-party rights, including rights under the Copyright Act (Title 17 U.S.C.), trademark law, privacy law, or other applicable laws.
6. Data Scraping, Automated Access, and Security
6.1 Prohibited Automated Access. Without our express prior written consent, you and any third party may not:
- Scrape, crawl, or harvest data from the Service,
- Use bots, spiders, crawlers, scripts, or other automated tools,
- Create, train, or improve external AI or machine learning models or datasets using any data from the Service,
- Bypass or attempt to bypass authentication, rate limits, or security controls,
- Reverse engineer, decompile, or attempt to derive source code or private APIs.
6.2 Legal Notice. Unauthorized access, scraping, or interference may violate the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the Stored Communications Act, the Digital Millennium Copyright Act (DMCA), and federal or state computer crime, intellectual property, and unfair competition laws. Clarity Social reserves all rights to pursue legal and equitable remedies, including injunctive relief, damages, and attorneys' fees.
7. Privacy and Data Use
Your use of the Service is also governed by our Privacy Policy (as may be made available through the Service), which describes how we collect, use, and disclose information. We may rely on third-party service providers (including but not limited to Supabase, Vercel, and related infrastructure and analytics providers) to operate the Service. Those providers may process or store your information in accordance with their own terms and applicable laws.
8. DMCA and Copyright Complaints
Clarity Social complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and will respond to valid notices of alleged copyright infringement. If you believe that content on the Service infringes your copyright, you may send a notice to our designated DMCA agent in accordance with 17 U.S.C. § 512(c)(3):

If you knowingly misrepresent that material or activity is infringing, you may be liable for damages, including costs and attorneys' fees, under the DMCA and other laws.
9. Free Expression, Political Neutrality, and Moderation
9.1 Free Expression. Clarity Social generally permits lawful political and ideological speech from across the political spectrum, including views that are controversial, unpopular, or offensive to some, so long as such content complies with these Terms and applicable law.
9.2 Political Neutrality. Clarity Social does not exist to promote any specific political party, ideology, or candidate. We aim to provide a space where users may discuss political topics while remaining responsible for their own speech.
9.3 Free Speech, Not Free Reach. Even when content is permitted to remain on the Service, Clarity Social may reduce its distribution or visibility (for example, by limiting recommendations or search rankings) in order to protect users, comply with law, or preserve the integrity of the platform.
9.4 Limits on Speech. Free expression on the Service does not protect:
- Illegal content or conduct,
- True threats or incitement to imminent violence,
- Harassment, bullying, or targeted abuse,
- Defamation, libel, or knowingly false statements of fact,
- Exploitation or sexual content involving minors.
9.5 Moderation Discretion. Clarity Social may remove or restrict content or accounts at its sole discretion, including where content violates these Terms, poses legal risk, or undermines the safety or integrity of the Service. We have no obligation to host or continue to host any particular content.
10. No Professional Advice
Content on the Service is provided by users for general information and discussion purposes only. It does not constitute medical, legal, financial, or other professional advice. You should not rely on any content on the Service as a substitute for professional advice, and you are solely responsible for your decisions and actions.
11. Service Availability and Changes
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
12. Platform Liability and Section 230 Protection
Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), Clarity Social is generally not liable for content posted by users. We do not endorse, guarantee, or assume responsibility for any User Content, and we are not obligated to pre-screen or review content before it appears on the Service.
You are solely responsible for your User Content and for any claims, damages, or liabilities arising out of or related to your User Content, including under defamation, privacy, intellectual property, and other laws.
13. Indemnification
You agree to defend, indemnify, and hold harmless Clarity Social, Inc., and its officers, directors, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to the Service,
- Your User Content,
- Your violation of these Terms,
- Your violation of any law or the rights of any third party.
14. Limitation of Liability
To the fullest extent permitted by law, Clarity Social will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to your use of or inability to use the Service.
In no event will the total aggregate liability of Clarity Social for all claims arising out of or relating to the Service or these Terms exceed one hundred U.S. dollars (US $100).
15. Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively by binding arbitration, rather than in court, except that you or Clarity Social may assert qualifying claims in a small claims court of competent jurisdiction.
Arbitration shall be conducted by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration will be conducted by a single arbitrator in South Carolina, United States. The language of arbitration shall be English.
You and Clarity Social agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding. You acknowledge and agree that you are waiving the right to a jury trial and to participate in a class action.
16. Governing Law
These Terms and any disputes arising out of or relating to them or the Service are governed by the laws of the State of South Carolina, without regard to its conflict of laws principles, and by applicable federal law.
17. Changes to These Terms
We may update or modify these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the Service after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
18. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason or no reason, including if we believe you have violated these Terms, pose a risk to the safety or integrity of the Service, or for operational or business reasons. Upon termination, all rights granted to you under these Terms will immediately cease, and your access to the Service may be disabled.
18.1 Account Deactivation. You may deactivate your account at any time through the Danger Zone section of your account settings. Deactivation temporarily hides your profile and content from other users. Your data is retained and your account can be reactivated at any time by logging back in.
18.2 Account Deletion. You may permanently delete your account through the Danger Zone section of your account settings. Upon requesting deletion, your account will enter a 30-day pending deletion period during which your profile and content are hidden. You may cancel the deletion and restore your account at any time during this 30-day window. After 30 days, your account and associated personal data will be permanently and irreversibly purged from our systems, subject to our data retention obligations described in the Privacy Policy.
Certain provisions of these Terms, including those relating to limitations of liability, indemnification, and arbitration, will survive termination or deletion.
19. Miscellaneous
Entire Agreement. These Terms, together with any other policies or agreements expressly incorporated by reference, constitute the entire agreement between you and Clarity Social regarding the Service.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign our rights and obligations under these Terms.
20. Acknowledgment
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
